Surfory User Agreement

Terms governing your use of the Surfory application.

Welcome to Surfory

This User Agreement ("Agreement") governs your use of the Surfory mobile application ("Surfory," "the App," "we," "us," or "our"). By downloading, installing, accessing, or using Surfory, you agree to this Agreement.

If you do not agree to this Agreement, do not use Surfory.

1. The Surfory Service

Surfory is a local-first, offline application that allows you to record personal surf stories, organize surf gear, browse bundled fictional coastal-community content, save favorite stories, and create short Studio video clips from selected photos.

Surfory does not require an online user account and does not provide a live social network, messaging system, matching service, or user-to-user communication service.

Core personal content is intended to be stored locally on your device. Surfory does not automatically publish your personal stories or media to a public Surfory network.

2. Eligibility and Lawful Use

You may use Surfory only in compliance with applicable laws, regulations, Apple's platform rules, and this Agreement.

The bundled fictional community is designed around adult fictional surfer profiles. You must not use Surfory in a manner that is unlawful, harmful, fraudulent, or intended to violate the rights of others.

3. Fictional Community Content

Surfory includes bundled fictional profiles, seed stories, community notes, and simulated activity so the Feed can be explored immediately without a live network connection.

Fictional means fictional: Profiles labeled "Fictional profile" are not live user accounts. Community notes and related activity are simulated on the device and are not communications from real Surfory users.

The fictional content is provided as part of the app experience. You must not misrepresent bundled fictional profiles or simulated activity as real people, real accounts, or evidence of a live social community.

4. Your Local Content

You may create and store surf stories, notes, photos, voice notes, gear records, favorites, and other supported content using Surfory.

You retain responsibility for the content you choose to create, import, record, export, or share. You represent that you have the rights, permissions, and authority necessary to use any content you add to Surfory.

You must obtain any necessary permission from people who appear in your photos, videos, or recordings where required by applicable law.

You agree not to use Surfory to create, store, export, or share content that:

You must also comply with the Content Guidelines available within Surfory. The Content Guidelines may provide additional practical rules for using the app's fictional community, personal stories, and local reporting features.

6. Report and Block Tools

Surfory provides report and block controls for supported fictional community content. Reporting content may hide it from the local presentation of the app immediately, and blocking a fictional profile may change the content shown on your device.

These controls are local app features. Because Surfory does not operate a live user-to-user social network, a local report does not necessarily send a message to a real content owner or another Surfory user.

7. Points and In-App Purchases

Surfory offers six consumable Points packs through Apple In-App Purchase: Spark, Glow, Pulse, Orbit, Nova, and Galaxy.

Purchases are processed by Apple through the App Store. Pricing, availability, taxes, billing, refunds where applicable, and payment processing are subject to Apple's terms and the rules applicable to your Apple account and jurisdiction.

Points are consumable digital items used only for eligible Studio exports within Surfory. A successful Studio clip export costs 100 Points.

You should review the purchase confirmation presented by Apple before completing an In-App Purchase.

8. Studio Exports

Studio allows you to select eligible photos from favorite stories, choose a template, and generate an MP4 clip on the device. A supported Studio export requires between 2 and 12 selected photos.

A successful export costs 100 Points. If an export cannot be completed successfully because of an app error or another supported failure condition, Surfory may handle the transaction according to the app's local export logic. You should not assume that a failed or interrupted process has produced a usable video unless the App confirms successful completion.

You are responsible for reviewing exported content before sharing it. Once you send an exported file to another app, platform, or person, that destination may apply its own terms and privacy practices.

9. Device Permissions

Certain features require access to device capabilities. Depending on the feature you choose, Surfory may request permission for:

You may allow or deny permissions through the system controls available on your device. Denying a permission may prevent the related feature from working, but should not prevent use of unrelated app features where technically possible.

10. Intellectual Property

Surfory, its app design, bundled fictional community content, templates, software, branding, graphics, and other original materials are protected by applicable intellectual-property laws.

Except for the rights expressly granted to you under this Agreement, no ownership interest or license is transferred to you.

You may not copy, redistribute, reverse engineer, modify, or exploit Surfory's protected software or bundled materials except where applicable law expressly permits such activity.

11. Apple and Third-Party Services

Surfory is distributed through Apple's App Store and may use Apple system frameworks and services, including StoreKit, App Tracking Transparency, device permissions, and system sharing interfaces.

Apple and third-party services are governed by their own terms, policies, and technical requirements. Your use of an external sharing destination or Apple service may therefore be subject to additional terms.

You acknowledge that Apple is not responsible for providing Surfory's customer support except to the extent required under applicable law or Apple's own policies. Nothing in this Agreement is intended to reduce any mandatory rights you may have against Apple or another party under applicable law.

12. Disclaimers

Surfory is provided on an "as available" basis to the extent permitted by applicable law. We do not guarantee that the App will always be uninterrupted, error-free, available on every device, or compatible with every future version of iOS.

Surfory is a personal journaling, organization, fictional-content browsing, and media-creation tool. It is not a navigation, emergency, weather, marine-safety, or surf-condition service.

You are responsible for making independent decisions regarding water conditions, personal safety, equipment use, and outdoor activities.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Surfory and its developers or operators will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of or inability to use the App.

Nothing in this Agreement excludes or limits liability that cannot legally be excluded or limited, including any rights that applicable consumer law makes non-waivable.

14. Changes to Surfory or This Agreement

We may update Surfory, modify features, or revise this Agreement to reflect product changes, legal requirements, security needs, or other legitimate operational reasons.

When this Agreement changes, the updated version may be made available through the App or another appropriate location. Continued use of Surfory after an updated Agreement becomes effective may constitute acceptance to the extent permitted by applicable law.

15. Termination

You may stop using Surfory at any time. You may also remove the App from your device.

Removing the App may delete locally stored content and locally maintained Points information, subject to device backups and operating-system behavior. You are responsible for exporting or preserving any content you wish to keep before removing local app data.

We may discontinue or modify Surfory where reasonably necessary, subject to applicable law and any rights that cannot be waived.
